WILL YOU APPLY TO STAY IN THE UK FOLLOWING BREXIT?

If the answer is YES, and you are a self-employed Construction worker, because of the recent changes in the laws and regulations governing self-emplyoment your application as a self employed construction worker may be subject to a self employment status check.

What is a self-employment status check?
HMRC want to ensure that all workers in construction are correctly engaged and paid for the work they do. They have formulated a criteria of practice conditions, factors that can be evaluated to establish whether a worker is engaged to work for a company as a genuinely self-employed individual or should more accurately be classified as a PAYE - Employee working under 'false self-employment'. This evaluation exercise is a self-employment status check.

Our intention is not to worry you, but we feel it is important that we make you aware of this important factor and how it may affect your application. You see, the HMRC strongly believes that under the new rules, the vast majority of workers in construction are not truly self-employed and are working under 'false self-employment' as they see it and therefore should in fact be classed as PAYE - employee's.

The process of applying to stay in the UK is an ideal opportunity for the HMRC to check your status.

If the HMRC find you have been working wrongly as self-employed and not PAYE - employed then you may have to pay unpaid back tax and NI and there could even be fines and penalties as well. But most importantly it could also jeopardise your application to stay in the UK.

How it works
When Aggregate Partners LLP collects payments from its clients in respect of services supplied by subcontractors, Aggregate passes on the CIS tax liability to the HMRC, the balance less our fee is then paid to the subcontractor. We summarise all payments made to the subcontractor and all deductions taken and passed on to the HMRC in a useful yearly statement provided to the subcontractor at the end of each tax year. Self-employed workers (subcontractors) also receive regular CIS remittance advice notes, detailing tax deducted / paid and payments received.

The arrangement between Aggregate Partners LLP and the subcontractor is in the form of a contract for services with Aggregate Partners LLP, not its clients. This ensures as a subcontractor your contractual rights are applied consistently with the right should you wish, to move freely from contractor to contractor, job to job.
